SCHOLFIELD, J. -- Coldwell Banker/San Juan Properties, Inc. (Coldwell), appeals from a summary judgment in favor of Blair and Beth Ward (Wards). The trial court ruled that Coldwell breached a fiduciary duty it owed to the Wards by failing to disclose information about the buyers of the Wards' home and by guaranteeing the buyers' bank loan without disclosure to the Wards or their consent. The court found Coldwell liable for the return of the real estate sale commission and the unpaid balance on the buyers' promissory note.*fn1 We reverse.
